November 2025 Enforcement Action Summary
This report includes formal enforcement actions issued or resolved by the Office of Compliance & Inspection (OC&I) for November 2025. This report is intended to inform the public of certain compliance/enforcement activities performed in the preceding month to protect the public's health, safety, welfare, and the environment.
Formal enforcement actions are taken to achieve compliance with law/regulations; remediate environmental damage; restore natural resources to appropriate conditions; impose penalties that capture the gravity of the situation and any economic benefit gained by the alleged violator; and deter similar actions in the future. Formal enforcement is generally in the form of a Notice of Violation (NOV) that alleges certain facts and violations, contains orders to resolve the alleged violations, contains an assessed penalty with supporting documentation regarding what factors OC&I used to determine the penalty, and, by law, allows a respondent the ability to appeal or contest the NOV to the Rhode Island Department of Environmental Management (RIDEM) Administrative Adjudication Division (AAD). Since most NOVs are contested cases, OC&I does not generally discuss the case with the public while the matter is awaiting hearing or pending negotiated settlement. NOVs are subject to release under the Access to Public Records law in Rhode Island. A copy of an individual NOV may be obtained through the RIDEM's Office of Customer and Technical Assistance. OC&I often resolve formal enforcement actions through negotiated settlement agreements prior to hearing before the AAD.
November 13, 2025 – Freshwater Wetlands File No. OCI-FW-24-163 re: The Vincent R and Colleen M. Graziano Revocable Trust for property located approximately 100 feet south of Henry Brown Road; approximately 2,300 feet east of the intersection of Henry Brown Road and Orion View Drive: utility Pole Nos 36 and 37, Assessor’s Plat 52, Lot 2-2, with an address of 280 Henry Brown Road, in West Greenwich, Rhode Island (“Property). Respondent owns the Property. OC&I alleges that Respondent violated Rhode Island’s Freshwater Wetlands Act, and the Regulations Governing the Administration and Enforcement of the Freshwater Wetlands Act (250-RICR-150-15-3). November 24, 2025 – Underground Storage Tank File No. OCI-UST-25-29-02986 re: Muhammad Ali Saleem for property located at 1836 Warwick Avenue, 1850 Warwick Avenue and Rosemere Avenue, Assessor’s Plat 329, Lots 404, 401, 408, and 409 in the City of Warwick Rhode Island (“Property”). Ther Property includes a motor fuel filling station and a convenience store (“Facility”). Respondent owns the Property. OC&I alleges that Respondent violated Rhode Island’s Underground Storage Facilities Used for Regulated Substances and Hazardous Materials (250-RICR-140-25-1). View the NOV.
November 26, 2025 - Onsite Wastewater Treatment System File No. OCI-OWTS-25-29 re: Misty Mornings, LLC for property located at 39 Anthony Street, Assessor’s Plat 63, Lot 9 in Coventry, Rhode Island. Respondent owns the Property. OC&I alleges that Respondent violated Rhode Island’s Rules Establishing Minimum Standards Relating to Location, Design, Construction and Maintenance of Onsite Wastewater Treatment Systems (250-RICR-150-10-6). November 26, 2025 – Dam File No. State I.D. 572 (Wilbur Pond Dam) and OCI-DAMS-13-85 and OCI-DAMS-15-8 and Superior Court File No. PC-2019-1480 re: Plaintiff Janet L. Coit, Director, RIDEM vs. Defendant TILLINGHAST HOLDING CO., LLC. for a dam located approximately 4,500 feet north of the intersection of George Washington Trail and Putnam Pike, approximately 2,000 linear feet west of George Washington Trail, Assessor's Plat 259, Lot 1, in the Town of Burrillville, Rhode Island. The dam is classified by the RIDEM as High Hazard. Defendant owns the dam. On May 24, 2016, the RIDEM issued an NOV to Defendant alleging that the dam is unsafe and that Defendant violated the Rhode Island Code of Regulations titled Rules and Regulations for Dam Safety (250-RICR-130-05-1). View the NOV. Defendant did not file an appeal of the NOV and did not comply with the NOV. On February 19, 2019, the RIDEM filed a complaint in Superior Court asking the court to order Defendant to comply with the NOV. View the Complaint. On November 17, 2025, prior to a hearing on the complaint, by agreement of the parties and permission of the Court an Order was entered dismissing the Complaint without prejudice. View the Order.
