May 2026 Enforcement Action Summary

This report includes formal enforcement actions issued or resolved by the Office of Compliance & Inspection (OC&I) for May 2026. This report is intended to inform the public of certain compliance/enforcement activities performed in the preceding month to protect the public's health, safety, welfare, and the environment.

Formal enforcement actions are taken to achieve compliance with law/regulations; remediate environmental damage; restore natural resources to appropriate conditions; impose penalties that capture the gravity of the situation and any economic benefit gained by the alleged violator; and deter similar actions in the future. Formal enforcement is generally in the form of a Notice of Violation (NOV) that alleges certain facts and violations, contains orders to resolve the alleged violations, contains an assessed penalty with supporting documentation regarding what factors OC&I used to determine the penalty, and, by law, allows a respondent the ability to appeal or contest the NOV to the Rhode Island Department of Environmental Management (RIDEM) Administrative Adjudication Division (AAD). Since most NOVs are contested cases, OC&I does not generally discuss the case with the public while the matter is awaiting hearing or pending negotiated settlement. NOVs are subject to release under the Access to Public Records law in Rhode Island. A copy of an individual NOV may be obtained through the RIDEM's Office of Customer and Technical Assistance. OC&I often resolves formal enforcement actions through negotiated settlement agreements prior to hearing before the AAD.

May 11, 2026 – Underground Storage Tank File No. OCI-UST-26-7-04759 re: 2340 West Main Realty LLC and Patriot West LLC for property located at 2340 West Main Road, Assessor’s Plat 56, Lot 6 in Portsmouth, Rhode Island (“Property”). The Property includes a convenience store and a petroleum product storage and dispensing system (“Facility”).  Respondent 2340 West Main Realty LLC owns the Property. Respondent Patriot West LLC operates the Facility.  OC&I alleges that Respondents violated Rhode Island’s Underground Storage Facilities Used for Regulated Substances and Hazardous Materials (250-RICR-140-25-1).  View the NOV

May 18, 2026 – Onsite Wastewater Treatment System File No. OCI-OWTS-24-95 re: SmithCo, LLC for property located at 375 ½ Cumberland Hill Road, Assessor’s Plat 41D, Lot 23 in Woonsocket, Rhode Island (“Property”). The Property contains a dwelling constructed in 1920 and believed to be serviced by a cesspool. Respondent owns the Property. OC&I alleges that Respondent violated The Rhode Island Cesspool Act of 2007 and Rhode Island’s Rules Establishing Minimum Standards Relating to Location, Design, Construction and Maintenance of Onsite Wastewater Treatment Systems (250-RICR-150-10-6). May 18, 2026 – Onsite Wastewater Treatment System File No. OCI-OWTS-26-11 re: Donna L. Marsella and Jeffrey A. Marsella for property located at 111 Charlotte Drive, Assessor’s Plat 201, Lot 132 in Warwick, Rhode Island (“Property”). The Property contains a dwelling serviced by a cesspool.  Respondents own the Property. OC&I alleges that Respondents violated The Rhode Island Cesspool Act of 2007 and Rhode Island’s Rules Establishing Minimum Standards Relating to Location, Design, Construction and Maintenance of Onsite Wastewater Treatment Systems (250-RICR-150-10-6). May 18, 2026 – Hazardous Waste File No. OCI-HW-25-58 re: Aspen Aerogels Rhode Island, LLC and Aspen Aerogels, Inc. for property located at 3 Dexter Road, Assessor’s Map 304, Block 1, Parcel 1 in East Providence, Rhode Island (“Property”). The Property includes a facility used for the manufacturing of specialty pipe insulation made of aerogel (“Facility”). Respondents operate the Facility. OC&I alleges that Respondents violated Rhode Island’s Rules and Regulations for Hazardous Waste Management (250-RICR-140-10-1).  View the NOV.

Mitchell for property located at 2550 East Main Road, Assessor’s Plat 35, Lot 20 in Portsmouth, Rhode Island (“Property”). Respondents own the Property. OC&I alleges that Respondents violated Rhode Island’s Rules Establishing Minimum Standards Relating to Location, Design, Construction and Maintenance of Onsite Wastewater Treatment Systems (250-RICR-150-10-6). May 28, 2026 – Hazardous Waste File No. OCI-HW-25-45 re: Robert W. Carosi for property located at 7 South Street, Assessor’s Plat 56, Lot 104 in Coventry, Rhode Island (“Property”).  The Property includes a residence.  Respondent owns the Property.  OC&I alleges that Respondent violated Rhode Island’s Oil Pollution Control Act and Rhode Island’s Oil Pollution Control Regulations (250-RICR-140-25-2). May 11, 2026 – Water Pollution File No. OCI-WP-24-20, STW22-032, FWW22-0076 & RIR102234 re:  A.G. Construction, Inc. for a property located at 1257 Central Avenue, Assessor’s Plat 43, Lot 96 in Johnston, Rhode Island.  On August 23, 2022, RIDEM issued a permit to Respondent to construct 4 single-family dwellings with garages, driveways, and associated infrastructure at the property.  On July 17, 2024, OC&I issued a NOV to Respondent alleging that Respondent violated the permit and Rhode Island’s Water Pollution Act, Water Quality Regulations (250-RICR-150-05-1)and Regulations for the Rhode Island Pollutant Discharge Elimination System (250-RICR-150-10-1). View the NOV. Respondent did not file an appeal of the NOV with AAD. Respondent paid a reduced penalty of $10,500 to resolve the NOV.

May 13, 2026 – Solid Waste File No. OCI-SW-17-29 and Hazardous Waste File No. OCI-HW-17-9 re: The Estate of Michael F. Zampini and Thomas Zampini dba Zampini Auto Wrecking for a property located at 2 Mill Road, Assessor’s Plat 1B, Lot 19 in the Town of Richmond, Rhode Island. The Estate of Michael F. Zampini owns the property. Thomas Zampini dba Zampini Auto Wrecking operates an automobile wrecking and salvage business on the property, which is licensed by the Town of Richmond, Rhode Island. On March 18, 2019, OC&I issued a NOV to Respondents alleging that Respondents violated Rhode Island’s Refuse Disposal Act, Rhode Island’s Oil Pollution Control Act, the Rhode Island’s Oil Pollution Control Regulations (250-RICR-140-25-2) and the Rhode Island’s Rules and Regulations for Hazardous Waste Management (250-RICR-140-10-1). View the NOV.  Respondents complied with the NOV and paid a reduced penalty of $6,713 to resolve the NOV. 

May 27, 2026 – Underground Storage Tank File No. OCI-UST-23-2-00505 re: WESTLAKES, LLC and Point Judith Road Food and Fuel, Inc. for a property located at 707 Point Judith Road, Assessor’s Plat Y4, Lot 4, in Narragansett, Rhode Island. The property includes a motor fuel filling station and a convenience store (facility).  WESTLAKES, LLC owns the property. Point Judith Road Food and Fuel, Inc. operates the facility. On August 24, 2023, OC&I issued a NOV to Respondents alleging that Respondents violated Rhode Island's Rules and Regulations for Underground Storage Facilities Used for Regulated Substances and Hazardous Materials (250-RICR-140-25-1). View the NOV. Respondent fully complied with the NOV and paid the administrative penalty.
