March 2026 Enforcement Action Summary

This report includes formal enforcement actions issued or resolved by the Office of Compliance & Inspection (OC&I) for March 2026. This report is intended to inform the public of certain compliance/enforcement activities performed in the preceding month to protect the public's health, safety, welfare, and the environment.

Formal enforcement actions are taken to achieve compliance with law/regulations; remediate environmental damage; restore natural resources to appropriate conditions; impose penalties that capture the gravity of the situation and any economic benefit gained by the alleged violator; and deter similar actions in the future. Formal enforcement is generally in the form of a Notice of Violation (NOV) that alleges certain facts and violations, contains orders to resolve the alleged violations, contains an assessed penalty with supporting documentation regarding what factors OC&I used to determine the penalty, and, by law, allows a respondent the ability to appeal or contest the NOV to the Rhode Island Department of Environmental Management (RIDEM) Administrative Adjudication Division (AAD). Since most NOVs are contested cases, OC&I does not generally discuss the case with the public while the matter is awaiting hearing or pending negotiated settlement. NOVs are subject to release under the Access to Public Records law in Rhode Island. A copy of an individual NOV may be obtained through the RIDEM's Office of Customer and Technical Assistance. OC&I often resolves formal enforcement actions through negotiated settlement agreements prior to hearing before the AAD.

March 5, 2026 – Underground Storage Tank File No. OCI-UST-25-53-01838 re: TK Cumberland LLC, Cumberland Miles Inc., and Shop N Fuel Inc. for property located at 1152 (a/k/a 1170) Mendon Road, Assessor’s Plat 34, Lot 28 in Cumberland, Rhode Island (“Property”). The Property includes a convenience store and a petroleum product storage and dispensing system (“Facility”).  Respondent TK Cumberland LLC owns the Property.  Respondents Cumberland Miles Inc. and Shop N Fuel Inc. operate the Facility. OC&I alleges that Respondents violated Rhode Island’s Underground Storage Facilities Used for Regulated Substances and Hazardous Materials (250-RICR-140-25-1).  View the NOV.

The Property includes a convenience store and a petroleum product storage and dispensing system (“Facility”).  Respondent Fuel Depot, Inc. owns the Property.  Respondent Marshall’s Construction and Sealcoating, LLC operates the Facility.  OC&I alleges that Respondents violated Rhode Island’s Underground Storage Facilities Used for Regulated Substances and Hazardous Materials (250-RICR-140-25-1).  View the NOV.

The Property a motor vehicle service station and a petroleum product storage and dispensing system (“Facility”).  Respondent owns the Property and operates the Facility. OC&I alleges that Respondent violated Rhode Island’s Underground Storage Facilities Used for Regulated Substances and Hazardous Materials (250-RICR-140-25-1).  View the NOV. 

March 16, 2026 – Dam State I.D. 572 (Wilbur Pond Dam) and Dam File No. OCI-DAMS-26-1 re: Tillinghast Holding Company, LLC for a dam located approximately 4,500 feet north of the intersection of George Washington Trail and Putnam Pike, approximately 2,000 linear feet west of George Washington Trail, Assessor’s Plat 259, Lot 1 in Burrillville, Rhode Island. Respondent owns the dam.  The dam is classified by RIDEM as High Hazzard. OC&I alleges that Respondent violated Rhode Island’s Rules and Regulations for Dam Safety (250-RICR-130-05-1.  View the NOV.

March 17, 2026 – Underground Storage Tank File No. OCI-UST-25-36-02778 re: Malin Bay, LLC for property located at 2949 Tower Hill Road, Assessor’s Plat 18-2, Lot 7 in South Kingstown, Rhode Island (“Property”). The Property includes a motor fuel filling station and a convenience store (“Facility”).  Respondent owns the Property and operates the Facility.  OC&I alleges that Respondent violated Rhode Island’s Underground Storage Facilities Used for Regulated Substances and Hazardous Materials (250-RICR-140-25-1).  View the NOV. 

March 23, 2026 – Hazardous Waste File No. OCI-HW-24-45 re: Arlington R.V. Supercenter, Inc. for property located at 966 Quacker Lane, Assessor’s Plat 226, Lot 0003 in Warwick, Rhode Island (“Property”).  The Property includes a facility used to sell new and used residential vehicles and trailers (“Facility”).  Respondent operates the Facility and is a small quantity hazardous waste generator.  OC&I alleges that Respondent violated Rhode Island’s Rules and Regulations for Hazardous Waste Management (250-RICR-140-10-1).  View the NOV.

March 23, 2026 – Air Pollution File No. OCI-AIR-25-68 re: EaglePicher Technologies for a facility located at 2000 South County Trail in East Greenwich, Rhode Island.  Respondent operates the Facility. OC&I alleges that Respondent violated Rhode Island’s Air Pollution Control Regulations, Part 9 titled Air Pollution Control Permits (250-RICR-120-05-9).  View the NOV. 

March 30, 2026 – Air Pollution File No. OCI-AIR-26-12 re: Herrick & White Ltd. For a facility located at 3 Flat Street in Cumberland, Rhode Island (“Property”).  Respondent operates a custom woodworking facility on the Property (“Facility”).  OC&I alleges that Respondent violated Rhode Island’s Air Pollution Control Regulations, Part 9 titled Air Pollution Control Permits (250-RICR-120-05-9) and Part 29 titled Air Pollution Control Regulations No. 29 – Operating Permits (250-RICR-120-05-29).  View the NOV.

March 31, 2026 – Dam State I.D. 273 (Wood River Junction Dam) and Dam File No. OCI-DAMS-24-11 re: Rhode Island Department of Transportation for a dam located approximately 785 feet east of the intersection of Church Street and Switch Road, approximately 15 feet north of Church Street, in Richmond, Rhode Island.  Respondent owns the dam.  The dam is classified by RIDEM as Significant Hazzard. OC&I alleges that Respondent violated Rhode Island’s Rules and Regulations for Dam Safety (250-RICR-130-05-1.  View the NOV.
