July 2025 Enforcement Action Summary
This report includes formal enforcement actions issued or resolved by the Office of Compliance & Inspection (OC&I) for July 2025. This report is intended to inform the public of certain compliance/enforcement activities performed in the preceding month to protect the public's health, safety, welfare, and the environment.
Formal enforcement actions are taken to achieve compliance with law/regulations; remediate environmental damage; restore natural resources to appropriate conditions; impose penalties that capture the gravity of the situation and any economic benefit gained by the alleged violator; and deter similar actions in the future. Formal enforcement is generally in the form of a Notice of Violation (NOV) that alleges certain facts and violations, contains orders to resolve the alleged violations, contains an assessed penalty with supporting documentation regarding what factors OC&I used to determine the penalty, and, by law, allows a respondent the ability to appeal or contest the NOV to the Rhode Island Department of Environmental Management (RIDEM) Administrative Adjudication Division (AAD). Since most NOVs are contested cases, OC&I does not generally discuss the case with the public while the matter is awaiting hearing or pending negotiated settlement. NOVs are subject to release under the Access to Public Records law in Rhode Island. A copy of an individual NOV may be obtained through the RIDEM's Office of Customer and Technical Assistance. OC&I often resolve formal enforcement actions through negotiated settlement agreements prior to hearing before the AAD.
July 16, 2025 – Air Pollution File No. OCI-AIR-24-77 re VIBCO, Inc. for property located at 75 Stilson Road, Richmond, Rode Island. The property includes a construction machine manufacturing facility (“Facility”). Respondent operates the Facility. OC&I alleges that Respondent violated Rhode Island’s Air Pollution Control Regulations titled Record Keeping and Reporting (250-RICR-120-05-14). View the NOV.
July 21, 2025 – Air Pollution File No. OCI-AIR-25-10 re Rhode Island Blood Center for property located at 405 Promenade Street, Providence, Rhode Island (“Facility”). Respondent operates the Facility. OC&I alleges that Respondent violated Rhode Island’s Air Pollution Control Regulations titled Air Pollution Control Permits (250-RICR-120-05-9) and Emission of Air Contaminants Detrimental to Person or Property (250-RICR-120-05-7.6). July 21, 2025 – Air Pollution File No. OCI-AIR-25-11 re Technic, Inc. for properties located at 41 Century Drive and 601 Park East Drive, Woonsocket, Rhode Island (“Facilities”). Respondent operates both Facilities. OC&I alleges that Respondent violated Rhode Island’s Air Pollution Control Regulations titled Air Pollution Control Permits (250-RICR-120-05-9) and Emission of Air Contaminants Detrimental to Person or Property (250-RICR-120-05-7.6). July 31, 2025 – Water Pollution File No. OCI-WP-24-124 re Leo Leone d/b/a Superior Air Duct Cleaning for property located at 725 Hope Street, Providence, Rhode Island. Respondent operates an air duct cleaning business named Superior Air Duct Cleaning. OC&I alleges that Respondent violated Rhode Island’s Water Pollution Act and the Water Quality Regulations (250-RICR-150-05-1). View the NOV.
July 10, 2025 – Underground Storage Tank File No. UST-24-37-01855 re: THE ORIGINAL BRADFORD SOAP WORKS, INC. for property located at 200 Providence Street, Assessor’s Plat 23, Lot 11 in West Warwick, Rhode Island. The property includes a manufacturing plant and a hazardous material storage and dispensing system (“Facility”). Respondent is the owner of the property and the operator of the Facility. On February 3, 2025, OC&I issued a NOV to Respondent alleging that Respondent violated Rhode Island’s Rules and Regulations for Underground Storage Facilities Used for Regulated Substances and Hazardous Materials (250-RICR-140-25-1). View the NOV. Respondent did not file an appeal of the NOV with AAD. Respondent complied with the Order section of the NOV and paid the full penalty assessed in the NOV.
July 10, 2025 – Dam Safety File No. OCI-DAMS-24-3 re: CPW True Storage, LLC and CPW Apartments, LLC for a dam identified as Cranston Print Works Dam, State Identification Number 172, located approximately 1,330 feet north of the intersection of Haven Avenue and Dyer Avenue, approximately 500 feet west of Dyer Avenue, Assessor’s Plat 8/5, Lot 195 in Cranston, Rhode Island. Respondents own the dam. The dam is classified by RIDEM as High Hazard. On July 12, 2023, OC&I issued a NOV to Respondent alleging that Respondents violated Rhode Island’s Rules and Regulations for Dam Safety (250-RICR-130-05-1). View the NOV. Respondent did not file an appeal of the NOV with AAD. Respondent fully complied with the NOV.
July 24, 2025 – Freshwater Wetland File No. OCI-FW-17-140 re: Eugene K. D’Allesandro, Jr. for a property located between 280 feet and 1,300 feet east/southeast of the eastern terminus of Tulip Hill Road, at House Number 4 (Tulip Hill Road), between 630 feet and 1,600 feet east/southeast of the intersection of Tulip Hill Road and Apple Blossom Drive, on Assessor’s Plat 55, Lot 175 (Lot 175) and between 280 feet and 740 feet south/southeast of the southern terminus of Poppy Hill Drive, between 1,100 feet and 1,700 feet southeast of the intersection of Poppy Hill Drive and Apple Blossom Drive, on Assessor’s Plat 55, Lot 34 (Lot 34) in Johnston, Rhode Island. Respondent owns Lot 175. Respondent acquired Lot 175 on May 29, 2015. John Lamothe and Alyssa Lamothe (Adjacent Owners) own Lot 34. The Adjacent Owners acquired Lot 34 on March 26, 2021. On July 22, 2022, OC&I issued a NOV to Respondent alleging that Respondent violated Rhode Island's Freshwater Wetlands Act and the Rules and Regulations Governing the Administration and Enforcement of the Freshwater Wetlands Act. View the NOV. Respondent filed an appeal of the NOV with AAD. Prior to an administrative hearing on the NOV, OC&I and Respondent executed a Consent Agreement to resolve the NOV. View the Agreement.
