August 2025 Enforcement Action Summary

This report includes formal enforcement actions issued or resolved by the Office of Compliance & Inspection (OC&I) for August 2025. This report is intended to inform the public of certain compliance/enforcement activities performed in the preceding month to protect the public's health, safety, welfare, and the environment.

Formal enforcement actions are taken to achieve compliance with law/regulations; remediate environmental damage; restore natural resources to appropriate conditions; impose penalties that capture the gravity of the situation and any economic benefit gained by the alleged violator; and deter similar actions in the future. Formal enforcement is generally in the form of a Notice of Violation (NOV) that alleges certain facts and violations, contains orders to resolve the alleged violations, contains an assessed penalty with supporting documentation regarding what factors the OC&I used to determine the penalty, and, by law, allows a respondent the ability to appeal or contest the NOV to the Rhode Island Department of Environmental Management (RIDEM) Administrative Adjudication Division (AAD). Since most NOVs are contested cases, the OC&I does not generally discuss the case with the public while the matter is awaiting hearing or pending negotiated settlement. NOVs are subject to release under the Access to Public Records law in Rhode Island. A copy of an individual NOV may be obtained through the RIDEM's Office of Customer and Technical Assistance. The OC&I often resolve formal enforcement actions through negotiated settlement agreements prior to hearing before the AAD.

August 7, 2025 – Air Pollution File No. OCI-AIR-23-103 re: Rhode Island Bioenergy Facility,
LLC for a property located at 289 Scituate Avenue, in Johnston, Rhode Island. The property includes an industrial anaerobic digester for food and other solid organic waste (facility). Respondent operates the facility. OC&I alleges that Respondent violated Rhode Island’s Air Pollution Control Regulations titled Air Pollution Control Permits (250-RICR-120-05-9) and Record Keeping and Reporting (250-RICR-120-05-14). August 14, 2025 – Onsite Wastewater Treatment System File No. OCI-OWTS-25-3 re: Yu Lin Zhang for a property located at 3351 East Main Road, Assessor’s Plat 24, Lot 59A in the Town of Portsmouth, Rhode Island. The property includes a commercial establishment known as Mindy’s Restaurant which is serviced by an onsite wastewater treatment system. Respondent owns the property. OC&I alleges that Respondent violated Rhode Island’s Rules Establishing Minimum Standards Relating to Location, Design, Construction and Maintenance of Onsite Wastewater Treatment Systems (250-RICR-150-10-6). August 19, 2025 – Onsite Wastewater Treatment System File No. OCI-OWTS-14-243 re: Mariam B. Evans for a property located at 229 Earle Drive, Assessor’s Plat 89, Lot 129 in the Town of North Kingstown, Rhode Island.  The property includes a single-family residence which is serviced by a cesspool.  OC&I alleges that Respondent violated Rhode Island’s Rules Establishing Minimum Standards Relating to Location, Design, Construction and Maintenance of Onsite Wastewater Treatment Systems (250-RICR-150-10-6). August 19, 2025 – Onsite Wastewater Treatment System File No. OCI-OWTS-24-101 re: Daniel P. Woods for a property located at 906 Anthony Road, Assessor’s Plat 4, Lot 201 in the Town of Portsmouth, Rhode Island.  The property includes a single-family residence which is serviced by a cesspool.  Respondent owns the property.  OC&I alleges that Respondent violated Rhode Island’s Rules Establishing Minimum Standards Relating to Location, Design, Construction and Maintenance of Onsite Wastewater Treatment Systems (250-RICR-150-10-6). View the NOV. 

August 20, 2025 – Water Pollution File No. OCI-WP-14-124 re: Carlo J. Izzo, Carlo J. Izzo, Jr. and Joanna Izzo for a property located at 2141 Plainfield Pike, Plat 32, Lot 7 in the Town of Johnston. The property is designated as a farm in accordance with DEM’s Farmland Designation Program. Respondents own the property. On August 24, 2020, OC&I issued a NOV to Respondents alleging that Respondents violated Rhode Island’s Water Pollution Act and Freshwater Wetlands Act, regulations titled Rules and Regulations Governing the Administration and Enforcement of the Freshwater Wetlands Act, and regulations titled Water Quality RegulationsView the NOV.  Respondents filed an appeal of the NOV with AAD. Prior to an administrative hearing on the NOV, OC&I and Respondent executed a Consent Agreement to resolve the NOV.  View the Agreement.

August 21, 2025 – Underground Storage Tank File No. UST 2013-138-01065 re: New England Farms Express for property located at 414 Smithfield Avenue, Assessor's Plat 77, Lot 821 in the city of Providence. The property includes a convenience store, a motor fuel filling station and underground storage tanks (USTs or tanks) used for the storage of petroleum products (facility). The Respondent owns the property and operates the facility. On February 20, 2014, OC&I issued a NOV to Respondents alleging that Respondent violated the RIDEM's Rules and Regulations for Underground Storage Facilities Used for Petroleum Products and Hazardous MaterialsView the NOV. Respondent did not file an appeal of the NOV with AAD. Respondent has demonstrated compliance with the UST Environmental Results Program.

August 21, 2025 – Underground Storage Tank File No. OCI-UST-23-22-01065 re: Ravi Kumar d/b/a New England Farms Express, LLC and MEGA GAS, LLC for a property located at 414 and 422 Smithfield Avenue, Assessor’s Plat 77, Lots 799 and 821 in Providence, Rhode Island. The property includes a motor fuel storage and dispensing system and a convenience store (facility). New England Farms Express, LLC owns the property. MEGA GAS, LLC. operates the facility. The Rhode Island Secretary of State revoked the Certificate of Registration for New England Farms Express, LLC on June 27, 2017.  Ravi Kumar is the last known Member of the company.  On October 13, 2023, OC&I issued a NOV to Respondents alleging that Respondents violated Rhode Island's Rules and Regulations for Underground Storage Facilities Used for Regulated Substances and Hazardous Materials (250-RICR-140-25-1). View the NOV. Respondents did not file an appeal of the NOV with AAD. Respondents complied with the Order section of the NOV and paid the full penalty assessed in the NOV.

August 14, 2025 – Underground Storage Tank File No. OCI-UST-23-12-01476 re: Asa U. Mumtaz. for a property located at 7780 Post Road, Assessor’s Plat 139, Lot 7, in North Kingstown, Rhode Island. ASNA Corp owns the Property.  The property includes a motor fuel storage and dispensing system, and a convenience store (facility). On October 12, 2022, the Certificate of Incorporation/authority for ASNA Corp was revoked by the Rhode Island Secretary of State.  Asa U. Mumtaz is the last known President of ASNA Corp.  On August 22, 2023, OC&I issued a NOV to Defendant alleging that Defendant violated Rhode Island's Rules and Regulations for Underground Storage Facilities Used for Regulated Substances and Hazardous Materials (250-RICR-140-25-1). View the NOV.  Defendant did not file an appeal of the NOV with AAD or comply with the NOV.  On August 14, 2025, RIDEM filed a complaint in Superior Court against Defendant asking the Court to order Defendant to comply with the NOV.  View the Complaint.
