April 2026 Enforcement Action Summary

This report includes formal enforcement actions issued or resolved by the Office of Compliance & Inspection (OC&I) for April 2026. This report is intended to inform the public of certain compliance/enforcement activities performed in the preceding month to protect the public's health, safety, welfare, and the environment.

Formal enforcement actions are taken to achieve compliance with law/regulations; remediate environmental damage; restore natural resources to appropriate conditions; impose penalties that capture the gravity of the situation and any economic benefit gained by the alleged violator; and deter similar actions in the future. Formal enforcement is generally in the form of a Notice of Violation (NOV) that alleges certain facts and violations, contains orders to resolve the alleged violations, contains an assessed penalty with supporting documentation regarding what factors OC&I used to determine the penalty, and, by law, allows a respondent the ability to appeal or contest the NOV to the Rhode Island Department of Environmental Management (RIDEM) Administrative Adjudication Division (AAD). Since most NOVs are contested cases, OC&I does not generally discuss the case with the public while the matter is awaiting hearing or pending negotiated settlement. NOVs are subject to release under the Access to Public Records law in Rhode Island. A copy of an individual NOV may be obtained through the RIDEM's Office of Customer and Technical Assistance. OC&I often resolves formal enforcement actions through negotiated settlement agreements prior to hearing before the AAD.

April 2, 2026 – Underground Storage Tank File No. OCI-UST-25-62-03176 re: Naveed Ahmad and Road Runners Food Mart, Inc. for property located at 2862 Hartford Avenue, Assessor’s Plat 57, Lot 61 in Johnston, Rhode Island (“Property”). The Property includes a convenience store and a petroleum product storage and dispensing system (“Facility”). INA Petroleum, Inc. owns the Property. On July 29, 2021, the Certificate of Incorporation/Authority for INA Petroleum, Inc. was revoked by the Rhode Island Secretary of State.  Naveed Ahmed is the last known president of INA Petroleum, Inc. Respondent Road Runners Food Mart, Inc. operates the Facility. OC&I alleges that Respondents violated Rhode Island’s Underground Storage Facilities Used for Regulated Substances and Hazardous Materials (250-RICR-140-25-1). The Property includes a convenience store and a petroleum product storage and dispensing system (“Facility”). Respondent Joanne Realty LLC owns the Property.  Respondent Lucky Star Gas LLC operates the Facility. OC&I alleges that Respondents violated Rhode Island’s Underground Storage Facilities Used for Regulated Substances and Hazardous Materials (250-RICR-140-25-1).  View the NOV.

April 15, 22026 – Underground Storage Tank File No. OCI-UST-25-33-03016 re: Ghassan Nayfeh and SUFI Inc. for property located at 717 Park Avenue, Assessor’s Plat 6, Lot 2162 in Cranston, Rhode Island (“Property”). The Property includes a motor fuel storage and dispensing system, and a convenience store (“Facility”).  Respondent Cranston 717, LLC owns the Property.  On July 22, 2019, the Certificate of Incorporation/Authority for Cranston 717, LLC was revoked by the Rhode Island Secretary of State. Ghassan Nayfeh is the last known authorized person for Cranston 717, LLC. Upon information and belief Respondent SUFI Inc. operates the Facility.  OC&I alleges that Respondents violated Rhode Island’s Underground Storage Facilities Used for Regulated Substances and Hazardous Materials (250-RICR-140-25-1).  View the NOV.

April 21, 2026 – Hazardous Waste File No. OCI-HW-25-33 re: Future Healthcare Systems N.E. Inc., Approved Storage & Waste Hauling N.E., Inc., and Approved Storage & Waste Hauling II, Inc. for property located at 65 Industrial Circle, Assessor’s Plat 02, Lot 109 in Lincoln, Rhode Island (“Property”).  The Property includes a regulated medical waste transfer station (“Facility”). Respondent Future Healthcare Systems N.E. Inc. owns the Property and operates the Facility.  Respondent Approved Storage & Waste Hauling N,E., Inc. is a permitted medical and hazardous waste transporter.  Respondent Approved Storage & Waste Hauling II, Inc. is a permitted hazardous waste transporter.  OC&I alleges that Respondents violated Rhode Island’s Rules and Regulations for Hazardous Waste Management (250-RICR-140-10-1). View the NOV.

April 7, 2026 – Air Pollution File No. AIR-25-83 re: Rhode Island Hospital for property located at 593 Eddy Street, Providence, Rhode Island (“Facility”). The property includes an acute care hospital.  Respondent operates the Facility. On January 16, 2026, OC&I issued a NOV to Respondent alleging that Respondent violated Rhode Island’s Air Pollution Control Regulations titled Operating Permits (250-RICR-05-27) and Air Pollution Control Permits (250-RICR-120-05-9). View the NOV.  Respondent did not file an appeal of the NOV with AAD.  Respondent complied with the NOV and paid the administrative penalty

April 7, 2026 – Air Pollution File No. OCI-AIR-25-68 re: EaglePicher Technologies for a facility located at 2000 South County Trail in East Greenwich, Rhode Island.  Respondent operates the Facility. On March 23, 2026, OC&I issued a NOV to Respondent alleging that Respondent violated Rhode Island’s Air Pollution Control Regulations, Part 9 titled Air Pollution Control Permits (250-RICR-120-05-9). View the NOV. Respondent did not file an appeal of the NOV with AAD. Respondent complied with NOV and paid the administrative penalty.

April 16, 2026 - Freshwater Wetland File No. OCI-FW-17-105 re: Stephen R. Archambault and David R. Dexter for property located approximately 280 feet southeast of Whipple Road, Utility Pole No. 26, approximately 1,700 feet south of the intersection of Whipple Road and Lantern Road, Assessor’s Plat 42, Lot 14A, Plat 42, Lot 23, Plat 42, Lot 36 and Plat 42, Lot 226, all in the Town of Smithfield, Rhode Island and Plat 44, Lot 10, Plat 44, Lot 217 and Plat 45, Lot 461, all in the Town of Lincoln, Rhode Island. Stephen R. Archambault and Marie Archambault own Plat 42, Lot 14A. The Mario Ciotola and Jenelita Ciotola Irrevocable Trust own Plat 42, Lot 23. David R. Dexter and Barbara M. Dexter own Plat 42, Lot 36. Stephen R. Archambault owns Plat 42, Lot 226 and Plat 44, Lot 10. Bruce Stoeckel and Valerie Stoeckel own Plat 44, Lot 217. Angellin LLC owns Plat 45, Lot 461. On July 30, 2019, OC&I issued a NOV to Respondents alleging that Respondents violated Rhode Island's Freshwater Wetlands Act and the Rhode Island Code of Regulations titled Rules and Regulations for Governing the Administration and Enforcement of the Freshwater Wetlands Act (250-RICR-150-15-1)View the NOV.  Respondents filed an appeal of the NOV with AAD.  Prior to an administrative hearing on the NOV, OC&I and Respondents executed a Consent Agreement to resolve the NOV.  View the Agreement.

April 27, 2026 – Underground Storage Tank File No. OCI-UST-18-77-00701 re: CHEBBO REALTY, LLC and BMC PETROLEUM INC. for property located at 905 Cranston Street, Assessor’s Plat 7/2, Lot 2943 in the City of Cranston, Rhode Island. The property includes a service station and a motor fuel storage and dispensing system and underground storage tanks that are used for storage of petroleum product (facility). CHEBBO REALTY, LLC owns the property. BMC PETROLEUM INC. operates the facility. On April 19, 2019, OC&I issued a NOV to Respondents alleging that Respondents violated the Rhode Island’s Rules and Regulations for Underground Storage Facilities Used for Regulated Substances and Hazardous Materials (250-RICR-140-25-1)View the NOV.  Respondents did not file and appeal of the NOV with AAD. Respondent complied with the Order section of the NOV but did not pay the administrative penalty assessed in the NOV. OC&I referred collection of the penalty to the Department of Revenue.  Respondents paid the full penalty assessed in the NOV plus interest to resolve the NOV.

April 27, 2026 – Underground Storage Tank File No. OCI-UST-20-17-01793 re: DIMAS REALTY, LLC and BMC PETROLEUM INC II for a property located at 135 Putnam Pike, Assessor’s Plat 40, Lot 100 in the Town of Johnston, Rhode Island. The property includes a convenience store and a motor fuel storage and dispensing system (facility). DIMAS REALTY, LLC owns the property. BMC PETROLEUM INC II operates the facility. On August 6, 2020, OC&I issued a NOV to Respondents alleging that Respondents violated regulations titled Rules and Regulations for Underground Storage Facilities Used for Regulated Substances and Hazardous MaterialsView the NOV. Respondents did not file and appeal of the NOV with AAD. OC&I referred collection of the penalty to the Department of Revenue. Respondents paid the full penalty assessed in the NOV plus interest to resolve the NOV.

April 30, 2026 - Underground Storage Tank File No. OCI-UST-25-53-01838 re: TK Cumberland LLC, Cumberland Miles Inc., and Shop N Fuel Inc. for property located at 1152 (a/k/a 1170) Mendon Road, Assessor’s Plat 34, Lot 28 in Cumberland, Rhode Island (“Property”). The Property includes a convenience store and a petroleum product storage and dispensing system (“Facility”).  Respondent TK Cumberland LLC owns the Property.  Respondents Cumberland Miles Inc. and Shop N Fuel Inc. operate the Facility. On March 5, 2026, OC&I issued a NOV to Respondents alleging that Respondents violated Rhode Island’s Underground Storage Facilities Used for Regulated Substances and Hazardous Materials (250-RICR-140-25-1). View the NOV. Respondents did not file an appeal of the NOV with AAD. Respondents complied with the Order section of the NOV and paid a reduced penalty of $1,500 to resolve the NOV.
